User Agreement

Use of the Affiliated Pediatric Practices (APP) website (the “Site”), is subject to the terms and conditions set forth below and those on the Site itself. You may not access or use the Site unless you agree to the following terms and conditions. Please read them carefully.

By accessing this Site, you acknowledge and agree that you have read this Agreement, agree and understand its terms. Please exit the Site immediately if you do not agree with these terms.

1.                  Protected Health Information.  The Site will enable you to communicate and transmit messages, files and other data regarding you, patients or APP. You will also be able to retrieve information from designated APP databases, including information regarding APP and patients of yours. The Standards for Privacy and Security of Individually Identifiable Health Information regulation promulgated pursuant to the Health Insurance Portability and Accountability Act of 1996 (42 U.S.C. 1320d-1329d-8; 42 U.S.C. 1320d-2) (ÒHIPAAÓ) establishes federal requirements for the use, disclosure, and security of individually identifiable health information (ÒPHIÓ). You agree not to use or further disclose any PHI other than as permitted by this Agreement and the requirements of HIPAA. You will implement appropriate safeguards to prevent the use or disclosure of PHI other than as provided for by this Agreement and shall report any use or disclosure of a PHI not provided for by this Agreement of which you become aware.

2.                  Third Party Information.  APP does not provide any warranties against any third party information on the Site.  Your use of third party content or information available via the Site is at your own risk.

3.         Your Password.  You agree and must ensure that your password is for your exclusive use.  You must not allow any unauthorized use of your password.  You will be responsible for all activity or transactions on the Site that are attributable to your password including, but not limited to, unauthorized use of the Site.

4.         Jurisdiction.  By using this Site, you agree that jurisdiction for any dispute with APP in any matter relating to your use of the Site resides exclusively in the Commonwealth of Massachusetts and you further agree and expressly consent to the exercise of personal jurisdiction in the courts of the Commonwealth of Massachusetts. Use of the Site is governed by the General Laws of the Commonwealth of Massachusetts.
